Intellectual and Industrial Property Policy

The User acknowledges and accepts that all the content that appears in this Website and in particular, designs, texts, images, logos, icons, buttons, software, trade names, trademarks, distinctive signs or any other signs that may be used industrially and/or commercially, are subject to Intellectual and Industrial Property rights, and that all Intellectual and Industrial Property rights regarding the contents and/or any other elements inserted in the website belong to ITALFARMACO and/or third parties or their license belongs to ITALFARMACO and/or third parties, and subsequently they have the exclusive right to use them in the course of trade.

As a result, the User must refrain from reproducing, copying, distributing, making available or in any other way publicly communicating, transforming or modifying said contents, except in the cases provided for by law or expressly authorised by ITALFARMACO, holding ITALFARMACO harmless from any claim arising from the user’s failure to comply with said obligation.

Under no circumstances does access to the Web Site imply that said rights have been partially or wholly waived, transferred, licensed or surrendered, nor does it confer on Users any other right to use, alter, exploit, reproduce, distribute or publicly communicate the Website and/or its Content other than those expressly provided for herein. Any other use or exploitation of any rights shall be subject to the prior and express authorisation specifically granted for this purpose by the company or any third-party holder of said rights. The use or reproduction of content or bases available for downloading, copying or printing of any content for free to everyone on the Online Platforms for personal and private use is exempt from the provisions of this paragraph.

The content, texts, photographs, designs, logos, images, software, source codes and, in general, any intellectual creation on this site, as well as the site itself as a whole, as a multimedia artistic work, are protected as copyright by intellectual property legislation. ITALFARMACO is the owner of the elements that make up the graphic design of this website, the menus, navigation buttons, HTML code, texts, images, textures, charts and any other content of the website or, in any case, has the corresponding authorisation to use such elements. The content provided on the Website may not be reproduced in whole or in part, nor transferred or recorded by any information retrieval system, in any form or by any means, unless prior written authorisation by the aforementioned company has been granted.

In any case, massive downloads of content or databases are prohibited, whether they are done manually or through computer programmes specifically designed for that purpose (spider software or similar).

Furthermore, the removal, bypass and/or manipulation of copyright or of any technical protection devices, or any information mechanisms that the content of this website may contain is forbidden. The User undertakes to respect the above-mentioned rights and to avoid any action that could damage them, and in any case ITALFARMACO reserves its right to exercise any legal measures or means it may be entitled to in order to defend its lawful intellectual and industrial property rights.

Unless otherwise expressly agreed for this specific case, by providing or including content in the Online Platforms or sending observations, opinions or comments to the site through the e-mail service or by any other means, the user implicitly grants ITALFARMACO a free, non-exclusive, world-wide license, without any time limit, to reproduce, publish, publicly communicate, transfer, in whole or in part, such content in any form or by any means or technology. The above-mentioned license shall expire the moment the User voluntarily removes said content from the Service. The User shall be the only person responsible for ensuring that this content is not contrary to Law or does not harm the rights or interests of ITALFARMACO or any third party and, therefore, users undertake to hold any injured party harmless.
